Limits To Suspension Of Civil Rights

 

Our Constitution (As includes The Bill Of Rights) lists some rights which have only the most rare limits as can be inflicted only in the most rare circumstances.

For example, the  right (ie Privilege in archaic terms) to Habeas Corpus may only be suspended, according to our Constitution: "The privilege of the writ of habeas corpus shall not be suspended, only in the case of "rebellion or invasion".

Please specially note that this, rare limit, to our Rights can be constitutionally applied only in such conditions AND that "public safety" alone does NOT allow for the suspension of such rights as:
1. Free speech;
2. The free exercise of religion; And,
3. The individual right of law abiding citizens (ie Age 18-years and above) to (Buy) "keep and bear arms" (ie Without "infringement").

Becoming Concerned About Race-Based Protests

I would be much more impressed with the causes of "racial justice protesters" if, and only if, the following were the case:

1. That White police officers were more likely to shoot Blacks than Black officers;

2. That Black criminals were not very much more involved in those crimes which "represent a clear and present danger of death or great bodily harm" as allows OR requires the use of lethal force to stop and that yielding a higher rate of Blacks being killed by police;

3. That there would be as much concern (eg Wakes, marches and the involvement of such as Al Sharpton) about the murder, by a looter, of retired St. Louis police officer David Dorn as there was for George Floyd;

4. That Black thugs would not select-out, on the basis of race, White victims at a rate many, many, times the reverse;

5. If those "after dark protesters" would not be so actively involved in arson, physical attacks on innocent Americans, looting and that as, very much, destroys the honest, family-supporting, employment of people-of-color workers and like employer's businesses; And,

6. If the, by many orders of magnitude, the primary murders of Blacks were not other Blacks.

Please let me know when all of the above is the rule so I can "become concerned".

Mobs & Their Suppression

Mobs are, as such, a probable “clear and present danger of death or great bodily harm” to others.

When such mobs are armed or commit such dangerous crimes as “Arson” (eg Both evident at Berkeley in recent days) they clearly demonstrate and multiply that “clear and present danger”---And justify the police or any good citizen to use any level of force (Including deadly force) to suppress that danger.

In fact, the failure of police (Or, if called up by Governors who understand their duties, the National Guard), to fire upon such extremely dangerous mobs as both individuals (ie By snipers under the direct control of a command officer) and by volley-fire in the case of any group attack is a gross neglect of duty.

It might be well for those who are members of such mobs or instigate-and-support such Fascist thugs to remember that the vast majority of privately held, military/police grade, firearms in the USA are in the possession of those citizens who are capable-and-willing to protect themselves, family, friends and “the common good” by using them to put down dangerous mobs in those failed jurisdictions where the police will not do so!

Such actions are matters of self-defense as extends to defense of others and community.

[The above possibility of citizen actions may well be the reason that the mis-leaders of the Democratic (sic) Party have taken the lead in attempts to deprive our fellow citizens of modern-and-effective firearms.]

[For general information, the hard touch of a triangular file to the lands of a gun's barrel and the lighter touch of a flat file to the firing-pin and extractor of such will negate the usual forensic information.]

Stress Test For Presidential Candidates

Some engineering/scientific companies/organizations will subject products/inventions to great stresses to determine if they will survive AND properly function under such conditions.

All of our modern Presidents live-and-function under perpetual levels of great stress. Other than the test of being POTUS candidates for that position can be

"stress tested" by public, open and unrestricted-subject debates.

The voters of our Republic have an absolute right to observe probable candidates Biden and Trump tested in that manner! And person(s) or organizations (eg Political Parties, Broadcast Networks) who block or attempt to block such debates are Fascists attacking Democracy.

I have not read or heard of any plans for a or (Hopefully) more debate(s) between Mr. Trump and Mr. Biden. Both of those candidates must, in the very near future, make arrangements for one/more such (Unrestricted as to subject materials) debates OR be declared an enemy of our nation's elections being 

based on an informed electorate! 

I Am A Corporation

Speaker Pelosi and other members of her Party are claiming that the GOP's plan to aid Americans, during the Chinese flu pandemic, favor "Corporations" over "people".

As a retired American my income is from a retirement fund which is based on the income and other successes of "Corporations". 

Aiding those companies helps protect my income---AND THAT OF MILLIONS OF LIKE (ie Habitually voting) FELLOW CITIZENS.

I suggest that: Ms. Pelosi and allies remember and consider the cited interest of we retired citizens; And, the GOP proclaim the above truth in-and-out of The Congress and in every public place.

["Chinese Virus" is an accurate term not used by those fools and traitors who support the tyrants who are, in fact, waging an asymmetrical WAR against the United States.]

Michigan's Governor, Nervous Americans & Armed Citizens

The Governor of Michigan can be described in such terms as “Asinine” and “Tyrant”. Such creatures (Their supporters AND those Americans who will not put themselves at risk to resist tyranny) should and must be kept very, very, nervous by their fellow (Law abiding) citizens who follow President Jefferson’s prescriptions. "The strongest reason for the people to retain the right to keep and bear arms is, as a last resort, to protect themselves against tyranny in government"; “What country can preserve its liberties if their rulers are not warned from time to time that their people preserve the spirit of resistance. LET THEM TAKE ARMS.”

It is and was past-the-time for Michigan’s Governor to be “warned”.

Protecting Wisconsin From A Tyrant

Wisconsin's Governor Evers has responded to the Legislature's GOP leadership filing of an action before Wisconsin's Supreme Court, challenging his extension of the "Stay At Home Order", by bleating that they are only interested in "power".

In fact and in honesty, they are attempting to protect the power that our State's Constitution (And laws) reserve to the democratically-elected Legislature and to protect The People from arbitrary seizure of such by a tyrannical, executive, branch of government.

Cuomo, State's Rights & State' Duties

Although I dislike stating so, I do agree with New York' Governor Cuomo's defense of the Tenth Amendment to our Republic's Constitution

as to "States Rights"---Within the meaning intended by the patriot Founders of our nation. (He should: Note the "...or to the people"

part of that provision AND defend the Second Amendment as also defined by those Founders).

After all, the 50-States (And other jurisdictions of the USA) each have, often different, problems. They must be free to exercise such powers

as, independently, address those disparate issues/needs as is, most specially, evident in this time of "The Chinese Virus".

My position is that such an exercise of power requires the like, independent, execution of duty. 

In the case of Federal assistance to counter that virus, Governor Cuomo must spend many hours less talking, talking and even more 

talking (ie Whining and sniveling) about the need for more Federal spending for New York State. He must look for such funds within the

Empire State to provide such moneys. I suggest he might well find those funds by:

1. Reducing the number of bureaucrats within NYS's public universities by 50%;

2. The reduction of each class of the three highest pay-grade employees in all, other, state agencies by 20%;

3. Removing State Police staff from its attempts to suppress the (Federal) Second Amendment and individual rights of law-abiding

citizens;

4. Eliminate all (ie Unconstitutional) "Affirmative Action Programs";

5. Inform the Federal Government that it will NOT accept any more, job-stealing and likely disease-bearing, illegal immigrants AND

enforce that policy by arresting such expelling them from NYS; And,

6. Other like, perhaps Draconian, methods.

THERE IS NOTHING IN OUR REPUBLIC'S CONSTITUTION WHICH ALLOWS ANY GOVERNMENT OFFICIAL OR BODY TO SUSPEND THOSE RIGHTS EXCEPT FOR THE 

VERY LIMITED EVENTS NOTED ABOVE

Perhaps, Michigan's Fascist governor might be better be reminded of the "Fist Amendment" by having  many thousands of law-abiding citizens of Michigan assembling about her office while openly carrying their deer rifles or other long arms.---THUS EXERCISING THE RIGHTS WHICH SHOULD BE SUPPORTED BY BOTH THE FIRST AND SECOND AMENDMENTS.

There are NO like provisions for the suspension of other rights.which include:

With regard to the "free exercise of religion" I must note that: Christians have a long history of supporting, if not requiring, communal worship; Jews are required to form Minyan of ten or more, adult, worshipers to have, real, worship; And, Sikhs require both communal prayer and a shared meal (ie Offered-to and shared-with all, Sikh or other/no religion).

THERE IS NOTHING IN OUR REPUBLIC'S CONSTITUTION WHICH ALLOWS ANY GOVERNMENT OFFICIAL OR BODY TO SUSPEND COMMUNAL WORSHIP WITH IS A CORE PART OF "THE FREE EXERCISE OF RELIGION". "Official" acts doing sore a (Actionable?) "Violation of civil rights under color of law" which may be a felony if anyone is injured in such violations.

Of course, religious leaders or bodies my suspend communal worship for any purpose as has been done in the face of the Chinese virus pandemic.

Viruses, Rallies, Conventions & Democracy

Many years ago I put my life at risk by enlisting in the US Navy. I was, indeed, was assigned to one of the five/six (Then) most dangerous, enlisted grade, billets. I survived and that undamaged in body and mind.

Our nation's VA-and-military hospitals and cemeteries are full of those who did not survive or now live in a very damaged state.

After that service I graduated university and was involved in "risky" (Paid and unpaid) civilian work as has been shared by many police officers, fire-fighters and other such heroes. Some of those also have "paid the price" of such duties.

For myself, I consider our "system" of political rallies and party-conventions essential to the maintaining of our Democratic-Republic.

If, and only if, we Americans still retain some small part of that courage (As demonstrated: From the Concord and Lexington of 1775 to those who today protect us us from those waging Jihad; And, the peace officers and fire-fighters of today) we should not avoid (ie Run away from) those, very public, demonstrations of our patriotic courage. Yes, there is some, very small, risk of physical harm or even death.

Is "bearing witness" to our nation at rallies, conventions and polling places still a part of our  People's character?

The Soros, Bloomberg & Abele Oligarchy

I do support collectives (eg Labor Unions, those law-abiding supporters of the NRA, those like citizen-groups opposed to the NRA, professional organizations) of our fellow Americans gathering, in small contributions, money to support or oppose candidates for public office or that like action for our political parties.

I am, very much, opposed to individual and very wealthy persons using their millions (Or more) to corrupt our Democratic-Republic's elections.

It appears that Abele (Milwaukee County Executive) has joined the Oligarchs George Soros and Michael Bloomberg in inflicting a "wealth attack" on our fellow citizens AND on democracy itself.

Guns, Trust, Democracy & Tyrants

In all of the debates and proclamations about the individual right, to "keep and bear arms", I have not seen-or-heard the following question: "Do those in favor of more restrictions on that right or its elimination trust our fellow, law-abiding, citizens?".

If not, why should such good citizens trust them (ie As concentrated in the Democratic-Socialist-FASCIST Party)?

That, very intense, mutual trust is the true basis of democracy. If political leaders (sic) do not trust The People they become tyrants. Such scum will inflict lies (ie A, single, murder by automobile in Charlottesville, VA, has any relationship to guns or the right of the People to bear them AND to freely assemble to petition their governments) or "set up" excuses for the further deprivation of constitutional rights.

Taking that right from our good citizens only provides protection for such criminals as ordinary thugs, those waging ideological warfare (eg Islamists 

inflicting Jihad; Member of "AntiFa") AND the cited tyrants.

Charlottesville, Violence, Guns & A Tyrant

Virginia's Governor has claimed that his claimed that his dictate banning firearms on the grounds of
that once-free State is based on the 2017 murder of one person during/about a "demonstration" in Charlottesville.

That lying Fascist avoided the following facts"
1. That murder was inflicted by the use of an automobile and not by any firearm or other "weapon";
2. (As far as I know) No misuse of firearms was had at/about that event/riot/demonstration; AND,
3. That "Executive Order" is in violation of the statements of other Virginians as:

A. "No freeman shall ever be debarred the use of arms"; "The strongest reason or the people to retain the right to keep and bear arms is, as a last resort, to protect themselves against tyranny in government"; “What country can preserve its liberties if their rulers are not warned from time to time that their people preserve the spirit of resistance. LET THEM TAKE ARMS.”. (President Thomas Jefferson); B. "The very atmosphere of firearms anywhere and everywhere restrains evil interference---They deserve a place of honor with all that is good.";  "Firearms are second only to the Constitution in importance; they are the peoples' liberty teeth". (President George Washington); C. “To preserve liberty, it is essential that the whole body of the people always possess arms and, and are taught alike, especially when young, how to use them.” (Richard Henry Lee Who offered the original motion for independence from England at the Second Continental Congress); a=AND, D. “To disarm the people is the best and most effective way to enslave them”  (George Mason, American Revolutionary) 

The Real Enemy Is NOT The PRC

At this time The Peoples Republic (sic) Of China is a clear-and-major threat to the USA and many nations in the West and those which are unfortunate to be neighbors to that China. A study of history reveals many such expansions of China as have been, without exception, followed by collapse and shrinkage of its areas of control. Much of that has been due to internal stresses.

That collapse could be accelerated by President Trump stopping all efforts for a trade agreement with the PRC AND, with the help of those Members of The Congress who are more interested in the safety of our Republic than in increasing their personal wealth, heavily taxing those now are grossly profiting from the direct and indirect trade with that tyrannical aggressor.

HOWEVER, the 1400-year and ongoing enemy of real civilization(s) is not the PRC but is Islam. Although individual, Islamist, nations may fight among themselves, they will (eg Today's government of Iraq) join to attack/resist any "unbelievers" (ie ~99% of our fellow Americans) who resist or attack Muslims.

The first and great expansion of that horrid ideology was stopped, by military action, at the walls of Vienna in 1683 and, by such force and to a lesser threat, in The Sudan in 1898.

After all, true-believing and orthodox Muslims must obey that fellow Mohammed's absolute and unalterable command to wage Jihad against we "unbelievers".

Those who aid such Muslims are "aiding the enemies" of the USA. In other

words, THEY ARE GUILTY OF TREASON as defined by our Constitution

and democratically enacted laws.
